City Preps Residents to Defend Beach Parking Zones

On the surface, it seemed just another meeting of city staff and their constituents.

But with seven Ocean Park preferential parking zones on the line - all of them more than 10 years old -, Saturday's meeting at the Ken Edwards Center was anything but routine.

Instead of just providing information and listening to concerns, planning department staff helped coach and organize some three dozen residents for a crucial Coastal Commission meeting Tuesday morning.

After a year's delay, the commission finally will decide the fate of 936 preferential parking spaces south of Pico Boulevard and east of Lincoln Boulevard that were created by the city without commission approval between 1983 and 1989. The commission discovered the spaces in 1998, while considering the Edgemar Development project on Main Street.

"Don't be exclusionary," Planning Director Suzanne Frick advised the residents. "What is important is to put a face on this issue. We don't want to alienate this commission."

Among the key points city staff encouraged residents to make are the dearth of street parking, the availability of parking in beach lots and the make up of the community (it is not just rich homeowners).

Residents who spoke at Saturday's meeting said they feared that if preferential parking is revoked they wouldn't be able to move their cars or entertain guests, especially on weekends, because there will often be nowhere to park near their homes.

"I can't leave during the day, but there are empty spaces on the beach," said one resident who lives in a zone near Main Street with no daytime restrictions. "As usual, the residents are going to be caught in the middle of this squabble."

While there are 2,400 spaces in Ocean Park's two beach lots, it costs $7 to park ($6 during the winter.) By comparison, unrestricted street parking is free.

Frick, however, warned against bringing up the underused lot, saying that lowering the rates - which already are cheaper than the rates at Venice Beach and Will Rogers State Park - is not on the table.

She did encourage residents who blamed the parking woes not on beach goers, but on employees and customers of Main Street businesses, to speak out on Tuesday.

"It's a major impact," said Roger Genser, a 22-year resident of Ocean Park who helped organize the first Ocean Park zone in 1983. "It was a reaction against Main Street. It had nothing to do with beach parking."

Historically, the Coastal Commission has granted permission for preferential parking zones in coastal communities, often imposing strict conditions to ensure plenty of public parking and beach access.

Since 1982 the commission has approved three applications from Hermosa Beach, Santa Cruz and Capitola. The commission, however, has denied preferential parking permits for Santa Monica's closest neighbors - Venice to the south and Pacific Palisades to the north.

In 1998 approximately 7.5 million visitors flocked to Santa Monica beaches. Over the past 28 years beach attendance has grown by 20 percent.

City Manager Susan McCarthy, who did not attend the meeting, said it would be "unforgivable" if residents weren't prepared given what's at stake.

"The Coastal Commission has a relatively clear mission laid out in the law, and in this situation, it may not be a mission that is sympathetic," McCarthy said. "This would certainly be a profound change."

In 1998 approximately 7.5 million visitors flocked to Santa Monica beaches. Over the past 28 years beach attendance has grown by 20 percent.

City Manager Susan McCarthy, who did not attend the meeting, said it would be "unforgivable" if residents weren't prepared given what's at stake.

"The Coastal Commission has a relatively clear mission laid out in the law, and in this situation, it may not be a mission that is sympathetic," McCarthy said. "This would certainly be a profound change."

The Coastal Commission will meet Tuesday at 10 a.m. at the Four Points Sheraton, 530 Pico Blvd.

City Preps Residents to Defend Beach Parking Zones

On the surface, it seemed just another meeting of city staff and their constituents.

But with seven Ocean Park preferential parking zones on the line - all of them more than 10 years old -, Saturday's meeting at the Ken Edwards Center was anything but routine.

Instead of just providing information and listening to concerns, planning department staff helped coach and organize some three dozen residents for a crucial Coastal Commission meeting Tuesday morning.

After a year's delay, the commission finally will decide the fate of 936 preferential parking spaces south of Pico Boulevard and east of Lincoln Boulevard that were created by the city without commission approval between 1983 and 1989. The commission discovered the spaces in 1998, while considering the Edgemar Development project on Main Street.

"Don't be exclusionary," Planning Director Suzanne Frick advised the residents. "What is important is to put a face on this issue. We don't want to alienate this commission."

Among the key points city staff encouraged residents to make are the dearth of street parking, the availability of parking in beach lots and the make up of the community (it is not just rich homeowners).

Residents who spoke at Saturday's meeting said they feared that if preferential parking is revoked they wouldn't be able to move their cars or entertain guests, especially on weekends, because there will often be nowhere to park near their homes.

"I can't leave during the day, but there are empty spaces on the beach," said one resident who lives in a zone near Main Street with no daytime restrictions. "As usual, the residents are going to be caught in the middle of this squabble."

While there are 2,400 spaces in Ocean Park's two beach lots, it costs $7 to park ($6 during the winter.) By comparison, unrestricted street parking is free.

Frick, however, warned against bringing up the underused lot, saying that lowering the rates - which already are cheaper than the rates at Venice Beach and Will Rogers State Park - is not on the table.

She did encourage residents who blamed the parking woes not on beach goers, but on employees and customers of Main Street businesses, to speak out on Tuesday.

"It's a major impact," said Roger Genser, a 22-year resident of Ocean Park who helped organize the first Ocean Park zone in 1983. "It was a reaction against Main Street. It had nothing to do with beach parking."

Tuesday's decision will center on whether Santa Monica's zones restrict access to the beach, which the Coastal Commission was created in 1976 to protect.

Commission staff has recommended that the seven zones be retained - with the caveat that the city must reapply for the permits in three years. The city opposes that condition, saying it would be too costly, inhibit long-range planning and leave residents in limbo. Instead city staff is proposing to conduct a parking monitoring program and file a report within five years.

Commission staff also is requiring the city to create 154 spaces to help replenish those taken up by preferential parking. Of these, 65 already have been created. The city also must keep the Tide and Pier beach shuttles running during the summer months.

While Coastal Commission staff seems sympathetic to the plight of beach area residents, it is impossible to predict what the commission will do, Frick said. One warning sign was a complaint by a commissioner who visited the beach to watch the sunset and found no place to park.

"We've been discussing this with the staff for a year and a half," Frick said. "I think this really boils down to philosophical issues with the commission."

Although the city has been negotiating with commission staff, it also has made it clear that it is prepared to file a lawsuit if the commission revokes the zones.

"We have a difference of legal opinion as to whether the Coastal Commission even has authority," Frick said. "We would prefer to go through the process and have a positive outcome."

Since the Coastal Act was passed in 1976, the Coastal Commission has required cities to apply for permits for the special parking zones.

Landlord Withdraws Ellis Filing, Tenants Celebrate

As the sun sank into the ocean Thursday evening the residents of 2121 Ocean Ave. gathered in the courtyard of their run-down beach front apartment complex. Despite a cold wind they laughed, snapped pictures and toasted each other with Frexinet Champagne and sparkling cider.

They had reason to celebrate.

Hours earlier, the 45 residents who live in the 39-unit complex received news they had dreamed about for a month. They would not be evicted from their homes.

"Everybody is very, very happy," said Dudley Cowan, 79, a 33-year tenant who fought in World War II and been given three months to two years to live due to a faulty heart. "That relieves a lot of stress. We're very happy. It takes a big load off me and the gang here. We breathed a collective sigh of relief. "

On Thursday morning - one day before his deadline to issue eviction notices -- building owner Richard Weintruab pulled his request to empty the building and quit the rental housing business under the state's Ellis Act.

Chris Harding, who heads up the law firm representing Weintraub, said his client made the decision several days ago not to evict his tenants.

"I think at this point he is planning on keeping the building as rental use," Harding said. "From our perspective, at least, we think Mr. Weintraub has acted responsibly."

For the tenants who live in the beachfront mustard-brown apartment building, with its peeling paint, Weintraub's act was a blessing.

"Today is a jubilant day," said Peggy Carter. Last week, Carter, one of the building's six seniors, had begun the task of cleaning out an apartment filled with 22 years of memories, inviting her daughter over to pick out photographs from her numerous albums.

"I'm levitating. We are levitating," said Mark Bitler, who had become the tenants' unofficial spokesperson and organizer in the month word whipped around the building that tenants would be facing eviction.

Weintraub, the son of longtime Los Angeles Board of Education member and one time L.A. City Council candidate Roberta Weintraub, bought the building on Dec. 9 1999. He was among the landlords of two dozen rent-controlled buildings who scrambled to get out of the rental business before Jan. 1, when a tough new amendment to the 1985 Ellis Act went into effect.

In what was the biggest flurry of Ellis Act filings in ten years, eviction notices were sent to more than 150 rental units during the last four months of the year, compared to the 123 eviction notices sent between May 1, 1998 and June 30, 1999.

The newly amended Ellis Act extends the length of an eviction notice from 30 to 120 days and a year for seniors and disabled persons. It also mandates that landlords wait two years - instead of one - before renting again. If a landlord returns to the rental business during the two-year waiting period, former tenants can sue for limited actual and specified punitive damages, and the Rent Board can sue for statutory exemplary damages.

Weintraub's Ellis withdrawal came in under the wire. He submitted the forms on Dec. 29, hours before the end of the city's work year and three days before the new amendment took effect. But his efforts to Ellis the building met with complications.

Two of the tenants held leases that extended beyond the 60 day period to empty the building, making Weintraub's attempt to go out of the rental business futile, especially after the tenants turned down offers to buy them out of their leases. City officials sent Weintraub a letter stating that they considered his Ellis filing was premature and ineffective. (They noted, however, that he can file to withdraw form the rental business under the new tougher law, which would bide the residents more time.)

"We're very happy," said Keith Kresge, a city staff attorney who works with the Rent Board. "We don't know what the future portends but we got the owner to revoke the Ellis withdrawal. We're cautiously optimistic."

To the residents of 2121 Ocean Ave., who are grateful to Weintraub, the leaseholders who refused buy out offers are heroes.

"I thought he had such integrity for holding out," said 79-year-old Dudley Cowan, of leaseholder Chris Cox.

"I need to move like I need a whole in my head," Cowan, a world traveler, who was once made a witch doctor during his many travels to Africa, said Wednesday.

Standing apart from the crowd in the courtyard, out of the cold wind, Cox smiled when he heard the compliment.

"It was an experience," said Cox, a television advertising salesman. "I'm not a wealthy person. I have debt. Any large amount of money would be beneficial. To me what was offered, with all the other factors, was not the right price. I don't know what would be the right price for all of these people. I'm glad it turned out this way."

The night before the good news, more than 30 tenants had met with members of the city's powerful grassroots organization Santa Monicans for Renters' Rights and lawyers from Legal Aid to discuss their options and legal recourse. On Thursday night, SMRR activist Michael Tarbet who spearheaded the meeting, brought the champagne.

"It's a very good feeling," said Tarbet. "I hope some more come out like this. Yes I was surprised."
